Insurance: Revises date of future repeal of exemption of medical malpractice insurance premiums from emergency assessments imposed to fund certain obligations, costs, & expenses of Florida Hurricane Catastrophe Fund & Florida Hurricane Catastrophe Fund Finance Corporation; authorizes uniform motor vehicle proof-of-insurance card to be in electronic format; provides construction with respect to parameters of person's consent to access information on electronic device presented to provide proof of insurance; provides immunity from liability to law enforcement officer for damage to electronic device presented to provide proof of insurance; authorizes DHSMV to adopt rules; authorizes insurers to furnish uniform proof-of-purchase cards in electronic format for use by insureds to prove purchase of required insurance coverage when registering motor vehicle; defines "authorized inspection agency"; requires chief inspector of state boiler inspection program to issue certificate of competency as special inspector to certain individuals; specifies how long certificate remains in effect; prohibits an insurance agency from conducting insurance business at location without designated agent in charge; revises date by which title insurance agencies & certain insurers must annually submit specified information to OIR.

Citizens Property Insurance Corporation: Revises definition of term "agency head" to include Financial Services Commission for purposes of Citizens Property Insurance Corporation; revises definition of term "state agency" to include Citizens Property Insurance Corporation; provides that certain residential structures are not eligible for coverage by corporation after specified dates; prohibits corporation from covering any new construction of major structure, or substantial improvements on any major structure, commencing on or after July 1, 2014, that is seaward of coastal construction control line or is within Coastal Barrier Resources System; restricts eligibility of risk for renewal policy issued by corporation; authorizes insurers taking out, assuming, or removing policies from corporation to use corporation's policy forms & endorsements for specified time without approval by OIR; authorizes corporation to adopt policy forms that allow corporation to replace or repair covered damage in lieu of paying value of loss.

Insurance: Revises criteria applicable to when office may hold public hearing regarding rate filing; revises restrictions on public adjuster compensation, payment, commission, fee, or any other thing of value; deletes provision requiring public adjuster to ensure prompt notice of property loss claims; requires public adjuster to ensure that prompt notice is given of claim to insurer; requires public adjuster to meet or communicate with insurer for specified purpose; prohibits public adjuster, public adjuster apprentice, or any person acting on behalf of public adjuster or apprentice to enter into contract or accept power of attorney relating to repair work; prohibits public adjuster from acquiring any interest in salvaged property; provides exception; deletes provision that limits amount that public adjuster may charge, agree to, or accept as compensation with respect to claim filed under policy of Citizens Property Insurance Corporation; requires corporation to prepare report for each calendar year relating to loss ratio attributable to losses that are not catastrophic losses for residential coverage provided by corporation; authorizes property insurance policy to prohibit post-loss assignment of rights, benefits, causes of action, or choses in action, except for specified purpose.

SB 1770

General Bill by Banking and Insurance
Property Insurance: Changing the name of the Florida Hurricane Catastrophe Fund Finance Corporation to the State Board of Administration Finance Corporation; providing that Citizens Property Insurance Corporation is an insurer subject to civil actions as an agent of the state covered by sovereign immunity; reducing the value of residential structures that can be covered by the corporation; requiring the corporation to have an inspector general; authorizing an insurer to offer a reduced amount of sinkhole coverage with an appropriate reduction in premium, etc.
Effective Date: Except as otherwise expressly provided in the act, this act shall take effect July 1, 2013.
